General terms and conditions

Server use

Global Internet Corporation reserves the right to refuse service and/or access to its servers to anyone.

Account Setup 

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. 

Global Internet Corporation reserves the right to move your domain to a different web server with no previous notice.

Content 

All services provided by Global Internet Corporation may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography. The customer agrees to indemnify and hold harmless Global Internet Corporation from any claims resulting from the use of our services.

Examples of unacceptable material:

IRC Bots
Warez Sites
Pirated Software
Hate sites
Hack programs and archives 

Zero Tolerance Spam Policy 

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice.

Global Internet Corporation reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with any of our policies, at its sole discretion.

Global Internet Corporation also reserves the right to make any such modifications in an emergency at our sole discretion. 

Global Internet Corporation reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Global Internet Corporation. Should our primary providers shut down our primary account because of your actions, then we will be seeking full compensation for our losses and losses of all accounts affected. All rights reserved. 

Payment Information 

You agree to supply appropriate payment for the services received from Global Internet Corporation, in advance of the time period during which such services are provided. You agree that until and unless you notify Global Internet Corporation of your desire to cancel any or all services received, those services will be billed on a recurring basis. 

Global Internet Corporation reserves the right to change the payment amount and any other charges at anytime. 

In situations where the card number on file is declined Global Internet Corporation will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, Global Internet Corporation reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

In order to streamline our accounting procedures and keep costs down Global Internet Corporation currently runs a limited number of payment options.

Credit / Debit Cards: Global Internet Corporation accepts MasterCard and Visa

Cheque Payment: This option is only available to Internet services agent business customers who pay annually for their Global Internet Corporation account. A credit/debit card number will still be required if customers require the facility to purchase domains and other services on-line. Global Internet Corporation cannot guarantee that a service will be provided until after any received cheques have been cleared.


Please note that whilst this email is primarily used for billing purposes, Global Internet Corporation reserves the right to email you information about enhancements to our systems and product offerings.

Backups and Data Loss 

Your use of the service is at your sole risk. Global Internet Corporation is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Global Internet Corporation servers. We highly suggest that you either fully backup your site, pay us to backup your site to a different server, or pay a third party to backup your site. Loss of data, although rare can happen, and could cost you immensely if you are not prepared. We repeat, Global Internet Corporation takes no responsibility for loss of files and data residing on your account.

Please note we may require suspension of some of our services for short scheduled periods to carry out maintenance or repair to our services. Although our aim is to provide better than 99.9% uptime, we cannot and will not guarantee uninterupted service. For sites needing higher than normal uptime reliability we recommend paying to place your site on redundant, load balanced servers with us.

Cancellation

Global Internet Corporation reserves the right to cancel the account at any time. 

Resource Usage 

When a website is found to be using more than its allocated resources, Global Internet Corporation reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Global Internet Corporation continues hosting the website for an additional fee.

Bandwidth Usage 

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month. 

Price Change

The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Global Internet Corporation, and the right to change the amount of resources given to plans at any time.

Indemnification 

Customer agrees that it shall defend, indemnify, save and hold Global Internet Corporation harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Global Internet Corporation, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Global Internet Corporation against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Global Internet Corporation; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Global Internet Corporation's server. 

Disclaimer

Global Internet Corporation will not be responsible for any damages your business may suffer. Global Internet Corporation makes no warranties of any kind, expressed or implied for services we provide. Global Internet Corporation does not back up your data/website unless it is placed on a load balanced server or requested and paid for, and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Global Internet Corporation cannot guarantee to be able to replace lost data. Global Internet Corporation disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Global Internet Corporation and its employees. Global Internet Corporation reserves the right to revise its policies at any time.
